These Terms govern your use of the Closby app and service, provided by VAEVI TECHNOLOGIES SP. Z O.O. (NIP 5213949908), ul. Puławska 12/3, 02-566 Warszawa, Poland. By creating an account you agree to them. Please read them with our Privacy Policy.
Closby is for adults only. You must be at least 18 years old to create an account, and by using Closby you confirm that you are. We operate a zero-tolerance policy toward any form of child sexual exploitation or abuse and toward any sexual content involving minors, and we report and act on it.
You sign in with your phone number and a one-time SMS code — one number, one account. Only one device can be signed in at a time. Provide accurate information and a username that isn't misleading or offensive. You are responsible for activity on your account and for keeping your device secure.
Be respectful. You must not: harass, threaten, bully or stalk; impersonate anyone; post hateful, violent, or sexually explicit content, or unsolicited sexual content; share content involving minors; spam or solicit; share illegal content; scrape, reverse-engineer, or automate access to the service; or use Closby to facilitate harm on or off the platform. We may remove content and suspend or terminate accounts that break these rules.
You own the content you post. You grant us a limited, non-exclusive, royalty-free licence to host, store, display and transmit it solely to operate the service — we do not use it for advertising or any other purpose. The licence ends when you delete the content or your account, except for copies that remain in the other participant's chat history, in backups for a limited time, or as needed for safety and legal reasons.
CLOSBY DOES NOT CONDUCT CRIMINAL BACKGROUND OR IDENTITY-VERIFICATION CHECKS ON ITS USERS. You are solely responsible for your own interactions, communications and conduct. Use caution and good judgement when talking to or meeting anyone; meet in public, tell someone where you're going, and trust your instincts. Closby is not responsible for the conduct of any user, whether online or offline, and does not guarantee that a person is who they say they are.
You can report, block and restrict other users from within the app, and you can undo a block at any time in Account → Settings → Blocked accounts. Reporting is our notice-and-action mechanism under the EU Digital Services Act: you can flag a person for spam, abuse, a fake profile or being under 18. Reports are reviewed by a human. When enough people report a profile it may be hidden automatically pending that review. You can also raise anything — including illegal content, and including a request for the reasons behind a restriction — by emailing hello@closby.org, and you may appeal any restriction at the same address; we respond to both.
We may remove or hide your profile, or terminate your access, for breach of these Terms or to protect users. You may stop using Closby and delete your account at any time. Deletion is handled as described in the Privacy Policy.
The service is provided "as is" and "as available". To the fullest extent permitted by law we are not liable for the conduct of users, offensive or unlawful content posted by others, or the consequences of interactions between users. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or under mandatory consumer-protection law.
These Terms are governed by Polish law, and disputes may be brought before the Polish courts. If you are a consumer in the EU, this does not deprive you of the mandatory protections of your own country's law or of your right to bring proceedings there. The European Commission's online dispute-resolution platform was discontinued on 20 July 2025 under Regulation (EU) 2024/3228; if you want out-of-court dispute resolution, contact your national consumer authority or an approved ADR body in your country. Closby is free to use; if we ever introduce paid features, applicable withdrawal rights will be provided at that time.

We may update these Terms; material changes will be notified in the app with a new effective date. Continuing to use Closby after a change means you accept the updated Terms; if you don't agree, stop using the service and delete your account.
